Staff Analysis of the Legislation

HB 137 amends § 16-1-12 of the O.C.G.A by prohibiting any attorney appointed by the Attorney General or district attorney to represent the state in a forfeiture action from being compensated based on a percentage basis of the assets arising from the forfeiture action or hourly basis capped at the value of said assets or any fee that is contingent upon winning the forfeiture action. The appointment and compensation for these attorneys must be in writing and filed with the court clerk. Copies must be provided to the presiding judge and the Prosecuting Attorney’ Council of the State of Georgia.
